PRAYER: Writ Petition filed under Article 226 of the constitution of India, to issue a writ of Mandamus, directing the first and second respondents to dispose of the objections of the petitioner dated 17.02.2020 and 18.02.2020 within a time frame as fixed by this Court besides directing them to reject the document presented by the third to fifth respondents group in pending document No.4 of 2020 on the file of the second respondent in the light of the earlier registration of the trust document dated 28.01.2020 in document No.4 of 2020 on the file of the second respondent in respect of petitioner trust namely Arulmigu Kaliamman Mariamman and Manthai Muniyandi Temple comprised in Survey No.233/1G1 and 234/4 situated at Valluvar Nagar, Nagaiyakottai Village, Gujiliamparai Taluk, Dindigul District.

ORDER

When it is pointed out that the nature of relief sought by the Petitioner in the Writ Petition involves private rights of the parties and could not be redressed by invoking the public law remedy following summary procedure under Article 226 of the Constitution, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to institute suit before the jurisdictional Civil Court for effectual and complete adjudication of the matter and he has made an endorsement to that effect, which is recorded. 2.

Accordingly, the Writ Petition is dismissed as withdrawn granting such liberty. Consequently, connected Miscellaneous Petition is closed. No costs.
