ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 17.12.2025 for the offences punishable under Sections 406 and 420 of IPC and 318(4) of BNS Act, 2023, in Crime No.16 of 2025 on the file of the respondent police, seeks bail.

2. The prosecution case is that the petitioner, by giving a false promise of securing a Government job, received a sum of Rs.77 lakhs from the defacto complainant and thereby cheated him. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is in judicial custody from 17.12.2025. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the 2/5

petitioner, by giving a false promise of securing a Government job, received a sum of Rs.77 lakhs from the defacto complainant and thereby cheated him. Therefore, he opposed for grant of bail to the petitioner.

5. The allegation against the petitioner is that he received a sum of Rs.77 lakhs on the promise of securing a job for the defacto complainant. The defacto complianant paid a sum of Rs.53 lakhs through bank transfer and the balance amount was paid in cash. Considering the seriousness of the offence, this Court is not inclined to grant bail to the petitioner. Further, it is seen that the defacto complainant had paid the said amount in order to secure a job. Paying a bribe is also a crime. Therefore, the prosecution is directed to take appropriate action against the defacto complainant as well for paying a bribe.

6. Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 16.02.2026 jbr 3/5
