Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Sections 341, 294(b), 506 (ii) of IPC and Section 3(1) (r), 3(1)(s) of SC/ST POA Amendment Act, in Crime No.74 of 2018, on the file of the respondent police, seeks anticipatory bail.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents.

3. The learned Government Advocate (Criminal side) strongly opposed grant of anticipatory bail to the petitioner as in view of the statutory bar.

4. The learned Counsel appearing for the petitioner pointed out that there is a political pressure behind the registration of the present FIR. He further pointed out that the petitioner filed a Writ Petition in W.P.(MD) No.6989 of 2018 and obtained police protection and thereafter only filed his nomination in the Cooperative Societies Election and that the case has been registered on the background of the Co-operative Election, and prays for anticipatory bail in favour of the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5. Considering the facts and circumstances of this case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned II Additional District and Sessions Court(PCR), Tirunelveli and executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
