PRAYER: Writ Petition filed under Article 226 of the constitution of India, to issue a writ of Mandamus, directing the Third Respondent to conduct the survey the land in S.No.302/1 situated at Athanakurichi Village, Posukudi Group, Muthukulathur Taluk, Ramanathapuram District based upon the District Munsif Court Decree and Judgment dated 01.12.2009 and based upon the Petitioner's representation dated 09.07.2019 and consequently directing the Third Respondent to issuance of patta in Petitioner's favour in survey No.302/1.

Learned Government Advocate, on instructions, states that the judgment and decree dated 01.12.2009 in O.S.No.1 of 1999 passed by https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.4768 of 2020 the District Munsif Court, Muthukulathur, relied on by the Petitioner for grant of patta has been set aside by judgment and decree dated 22.03.2013 in A.S.No.37 of 2011 passed by the Subordinate Judge, Paramakudi. He has also produced a copy of the same.

In that backdrop, Learned Counsel for the Petitioner seeks permission of this Court to withdraw this Writ Petition and he has also made an endorsement to that effect, which is recorded. 4.

Accordingly, this Writ Petition is dismissed as withdrawn. Consequently, the connected Writ Miscellaneous Petition is closed. No costs.
