O R D E R

This Criminal Original petition is filed for a direction to the respondent to file a final report after completion of investigation in Crime No.202 of 2016 pending on the file of the respondent police.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal Side) appearing for the respondent.

3. On the basis of the complaint given by the petitioner, it is stated that a case was registered in Crime No.202 of 2016 for the offences under Sections 294(b), 506(ii), 452, 468, 471, 420 and 109 I.P.C. It is further stated that no investigation was done and that there was no progress.

4. The learned Government Advocate(Criminal Side) however on instructions submitted that the enquiry was completed and the case was closed as "Mistake of Fact" on 13.04.2016. The learned https://hcservices.ecourts.gov.in/hcservices/

Government Advocate(Criminal Side) submitted that R.C.S.Notice was served on the petitioner and that the complaint itself was closed on the basis of the letter given by the petitioner, not to pursue the case.

5. However, the said statement of the learned Government Advocate(Criminal Side) that the service of R.C.S.Notice served on the petitioner is disputed by the learned counsel for the petitioner. Hence, the learned Government Advocate(Criminal Side) submitted that he has now served a copy of notice to the learned counsel for the petitioner.
