O R D E R

(Order of the Court was made by G.K.ILANTHIRAIYAN, J.) This Habeus Corpus Petition has been filed to direct the respondents herein to secure the petitioner's husband namely Rahul, S/o.Seenivasan aged about 36 years and produce him before this Court and set him at liberty based on the petitioner's representation dated 27.01.2026

2. The petitioner is the wife of the detenu. She got married the detenu on 12.09.2022 and thereafter due to misunderstanding they got separated. Thereafter in the year 2023 her husband went to qatar for his avocation. In his absence the father of the detenu filed petition for divorce as against the petitioner herein in HMOP No.462 of 2023 before

the Family Court, Thoothkudi. There also the detenu did not appear before the Family Court. The petitioner filed complaint under domestic violence act in DVC No.19 of 2024 on the file of the learned Judicial Magistrate, Virudhunagar. Even after receipt of notice the detenu did not appeared before the Court. The Domestic Violence complaint was also lodged against the detenu and his family members. The petitioner aggrieved over the same, filed quash petition in Crl.O.P(MD) No.22241 of 2025 before this Court and the same is pending adjudication. In the meanwhile the petitioner lodged complaint alleging that her husband is missing. Even according to the petitioner her husband went to qatar and thereafter she filed complaint under the Domestic Violence Act, therefore it cannot be stated that the detenu is under illegal detention of any one.

3. In view of the same, the present petition is not maintainable and the same is liable to be dismissed.
