O R D E R

This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, to direct the respondents to grant permission and necessary protection to conduct the "Adal Padal" programme on 25.02.2023 at 07.00 pm to 10.00 pm in connection with "Thiru Vizha" of Arulmigu Sri Pambalammal Thirukovil at Therkunatham Village, Aruppukottai Taluk, Virudhunagar District.

2.The learned Additional Public Prosecutor takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3.The learned counsel appearing for the petitioner submitted that "Thiru Vizha" of Arulmigu Sri Pambalammal Thirukovil at Therkunatham Village, Aruppukottai Taluk, Virudhunagar District, is going to be held on 25.02.2023. Subsequent to the same, in order to conduct a cultural programme on the same day (25.02.2023), they sought permission of the police by giving a representation dated 09.02.2023. But, the second respondent has not considered the said representation. 2/5

Since no order was passed, the petitioner has come before this Court for the above said relief.

4.The learned Additional Public Prosecutor appearing for the respondents would submit that totally 12 cases have been registered under various provisions of law including the Special Act regarding the celebration of festival in the above said village. He would further submit that the second respondent has received the representation of the petitioner and the same is pending for consideration.

5. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

6. In view of the submission made by the learned counsel for the petitioner, the second respondent is directed to consider the petitioner's representation on 09.02.2023 and pass orders immediately. If the second respondent is decided to grant permission to the petitioner, taking note the of circular issued by the Director General of Police, Tamil Nadu, Chennai, in Rc.007301/Genl.I (1)/2019, dated 09.04.2019, along with instructions to the Inspectors of Police throughout Tamil Nadu for 3/5

consideration of applications seeking permission for conducting cultural programme. Depending upon the out come, the petitioner can work out his remedy before the appropriate forum.

7. With the above direction, this writ petition is disposed of. No costs.
