Respondent PRAYER: This Criminal Original Petition has been filed under Section 482 of the Code of Criminal Procedure, to direct the respondent/police to seize/freeze a sum of Rs.2Lakhs, which is deposited in the name of Rajendran in account No.20654 in Post Office in Paramakudi by invoking the powers bestowed under Section 102 Cr.P.C. and to bring the money so seized/freezed to the Court of learned District Munsif cum Judicial Magistrate of Ilayangudi by invoking the powers given under Section 91 of Cr.P.C. or by filing necessary petition before the learned Chief Judicial Magistrate of Sivagangai under Section 92 Cr.P.C. seeking an order against the postal department to send the sum to the Court of learned District Munsif cum Judicial Magistrate of Ilayangudi. ORDER

Heard the learned Counsel for the petitioner and the learned Government Advocate(Crl.Side) appearing for the respondent.

2. The grievance of the petitioner is that the respondent has not taken any steps under Section 92 Cr.P.C. to recover the amount which is lying on the postal department.

3. The learned Government Advocate (Crl.Side), on instructions, would submit that already a letter has been addressed to the learned District Munsif cum Judicial Magistrate, Ilayangudi under Section 92 Cr.P.C. He also produced a copy of the same.

Taking into consideration the above said facts, the learned District Munsif cum Judicial Magistrate, Ilayangudi is directed to pass appropriate orders on the petition submitted by the respondent within a period of four weeks from the date of receipt of a copy of this order.

Accordingly, the Criminal Original Petition is disposed of with the above directions.
