O R D E R

This Criminal Original Petition has been filed by the petitioner to direct the 1st respondent not to harass him and his family members and do not compel him to repay the earlier sale amount to the 2nd respondent, under the guise of enquiry. 2.The case of the petitioner is that he sold his spare parts shop to the second respondent and the second respondent took over the shop and was doing business for some time. Though the petitioner paid the entire amount that was received as advance from the second respondent, the second respondent asked the petitioner to repay the money and that therefore, a complaint has also been given by the second respondent in this regard. From the petition filed by the petitioner, the facts regarding the dispute between the petitioner and the second respondent is not clear. 3.

However, the learned Government Advocate (Crl.Side), on instructions, submitted that the second respondent has given a complaint as if the petitioner has cheated by receiving some money and not honouring his commitment. It is further stated that the petitioner has actually prevented the second respondent to have https://hcservices.ecourts.gov.

entry into the premises. In such circumstances the second respondent is directed to register a case, in case cognizable offences are made out, as against the petitioner. Even if the presence of the petitioner is required for any enquiry, the same shall be done only after issuing summons in the manner known to law.

4.With these observations, this Criminal Original Petition is closed.
