ORDER : The Court Made the following order :- The petitioner/first accused, was arrested and remanded to judicial custody on 03.11.2016 for the alleged offences punishable under Sections 5(1)(1) ITP Act and 370(A)(5), 373 of IPC and Section 17 POCSO Act, 2012 and Section 3(1)(W-1, II), 3(11)(V)(a) of SC/ST (POA) Act in Crime No.21 of 2016 on the file of the respondent police and hence, seeks bail.

2.The learned Government Advocate (Crl.side) states that totally there are 18 accused in this case and A3 and A4 were arrested and they are in custody and remaining accused were enlarged on bail and A1 and A2 forced the minor girl for prostitution and they were released on bail by the concerned Sessions Court. The petitioner herein is arrayed as A4. The third accused is the mother of two victims in this case and investigation is over in this case.

3. The learned counsel for the petitioner states that the petitioner is not connected with the crime and she has no nexus in the crime and she has been falsely implicated in this case and the petitioner's name was not found in FIR and the petitioner was arrested and in custody from 03.11.2016.

4. Considering the above facts and circumstances of the case and also considering the fact that investigation is over in this case and considering the period of incarceration of the petitioner, https://hcservices.ecourts.gov.in/hcservices/

this Court is inclined to grant bail to the petitioner with certain condition. Accordingly, the petitioner is ordered to be released on bail on each her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Fast Track Mahila Court, Sivagangai and on further condition that the petitioner shall appear before the respondent police daily at 10.30., a.m., until further orders. sd/- 06/02/2017 / TRUE COPY / Sub-Assistant Registrar (C.S.)
