O R D E R

The petitioner, who is one of the accused in CC No.90 of 2017, pending on the file of the Judicial Magistrate Court No.VI, Trichy has approached this Court, for speedy disposal of the above case. 2.The learned counsel appearing for the petitioner submits that the trial in C.C No. 90 of 2017 is getting delayed, due to nonappearance of the other accused. Hence, the learned counsel prays this Court a suitable direction may be issued to expedite the trial. 3.It is very unfortunate that the accused has approached this Court, seeking a speedy disposal of the case, which is pending from the year 2017. Pendency of a case for the past 7 years would certainly affect the esteem of the Judiciary. If any one of the accused has not appeared, the learned Magistrate ought to have split up the case for the available accused and proceeded with the trial and concluded the trial by this time. However, in the present case, it was not done so. 2/5

4.In view of the above, the learned Judicial Magistrate No.VI, Trichy is directed to conclude the trial C.C No. 90 of 2017, by splitting up the case for the available accused and conclude the same, within a period of three months from the date of receipt of a copy of this order.
