ORDER

The petitioner is working as an Assistant Commissioner of Urban Land Tax and Urban Land Ceiling Department at Tiruchirappalli. He claims that he belongs to the Scheduled Caste of Adi Dravidar (Arunthiriyar) Community and he is having a special reservation for Arunthiriyar and therefore, he ought to have been promoted as Deputy Collector with effect from 2022-2023 as per G.O.Ms.No.55, Personal and Administrative Reform(s) Department, dated 08.04.2010. However, without considering the same, the Department has prepared a panel in the year 2022-2023 for the post of Deputy Collector and promoted one Chellapandi and one S.Prakasam, who is the 4th respondent herein. 2/5

Therefore, the petitioner has submitted a representation dated 17.102.2023 to the respondents, seeking to consider his case, in the light of G.O.Ms.No.55 Personal and Administrative Reform(s) Department, dated 08.04.2010 and to promote him as a Deputy Collector with effect from 2022-2023.

Mr.G.V.Vairam Santhosh, learned Additional Government Pleader, takes notice for the respondents 1 to 3 and submits that this panel has been prepared in the year 2022-2023 and the same has also been effected. The persons, who have been selected as per the panel, have been appointed as Deputy Collector. He further submits that the petitioner has submitted a representation on 17.10.2023 and approached this Court only after a period of two years. Now, the petitioner has been promoted as Deputy Collector on 09.01.2026.

3. This Court considered the rival submissions made.

4. The petitioner is seeking the relief based on the panel prepared in the year 2022-2023 and that has already been effected. In the event, if 3/5

the petitioner is aggrieved over the selection of panel of the year 2022-2023, which has not been followed with proper reservation, it is open to the petitioner to challenge the panel in the manner known to law.
