Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to terminate the pregnancy of petitioner minor daughter namely P.Akshaya daughter of Pazhanichamy aged about 15 years, a victim in crime No.317/2021 on the file of the 2nd respondent forthwith or at the earliest.

ORDER

The writ petition has been filed in the nature of Mandamus, seeking a direction to the first respondent to terminate the pregnancy of the petitioner's daughter namely, P.Akshaya, D/o Pazhanichamy, aged about 15 years, a victim in crime No.317 of 2021 on the file of the second respondent.

2.While pending this writ petition, this Court directed the petitioner's daughter to be present before the first respondent on 12.03.2022 to verify her physical fitness and stage of pregnancy to certify that she is fit for termination of her pregnancy. However, after direction issued by this Court, the petitioner's daughter again eloped with the boy, who fell in love with her. Even till today, the second respondent is not able to secure the daughter of the petitioner herein.

W.P(MD).No.4326 of 2022 3.Therefore, the prayer sought for in this writ petition cannot be granted. Accordingly, the writ petition stands dismissed. No costs. However, the petitioner is at liberty to approach this Court, whenever the petitioner's minor daughter get secured.
