Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the above mentioned Resolutions Nos.243, 244, 258 to 268, 269, 279, 281, 283, 285, 286 Passed on 15.12.2025 by the 5th respondent and to quash the same in so far as petitioners concerned and consequently direct the 4th and 5th respondents to reconduct the meeting by following the due procedures under the TN Urban Local Bodies Rules, 2023 and to pass the fresh resolution. ORDER
The present writ petition has been filed seeking to challenge the resolution passed by the 5th respondent Municipal Council on 15.12.2025.
2. According to the learned Counsel appearing for the writ petitioners, the resolutions are contrary to the statutory provisions and they have not been passed by the majority of the members.
3. As per Section 42 of the Tamil Nadu Urban Local Bodies Act, 1998, the Commissioner is authorised to consider the allegations made as against the resolution of the Municipal Council or the petitioner can approach the concerned District Collector for cancellation of the said resolution. This Court is not inclined to interfere in the resolution passed by the Municipal Council.
4. With the above said liberty, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are also closed. 19.02.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/5
