ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to dispose of the appeal dated 13.01.2020, within a stipulated time frame to be fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that the subject property is ancestral in nature and has been in the continuous possession and enjoyment of the petitioner's family for several decades. While so, the Trichy Corporation disturbed the petitioner's peaceful possession and enjoyment of the property. Hence, the petitioner and his wife filed a suit in O.S.No.853 of 2005 seeking declaration and permanent injunction before the Principal District Munsif Court, Tiruchirappalli. The said suit was decreed on 29.03.2006. Pursuant to the said decree, the petitioner approached the second respondent seeking issuance of patta in his favour by way of a representation dated 23.02.2013. Since the said request was not considered, the petitioner approached this Court by filing W.P. (MD)No.4548 of 2013. By order dated 17.11.

2017, this Court directed the second respondent to pass orders on the petitioner's representation dated 23.02.2013. Thereafter, the second respondent, vide proceedings dated 17.12.2019, rejected the petitioner's request on the ground that no revenue records pertaining to the petitioner's ownership of the subject property were produced. Aggrieved by the same, the petitioner preferred an appeal before the first respondent on 13.01.

and the same is still pending without any progress. Hence, the petitioner has been constrained to approach this Court by filing the present writ petition seeking the relief stated supra.

4. The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's appeal will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.

5. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's appeal dated 13.01.2020, and pass appropriate orders on merits and in accordance with law after providing reasonable opportunity of hearing to the petitioner, any other persons, who may be affected by such decision, within a period of sixteen weeks from the date of receipt of a copy of this order.
