O R D E R

This petition has been filed by the petitioner to direct the third respondent herein to take the petitioner's complaint, dated 16.09.2024 and to take action to file FIR and investigate the same and file Final Report.

2. Mr.R.M.Anbunithi, learned Additional Public Prosecutor takes notice for the respondents.

3. The learned counsel for the petitioner would submit that the petitioner is the victim and on 11.09.2024, at about 6.30 p.m., one Rajkumar, Prakash, Vijayakumar and Malarkodi trespassed into the house of the petitioner and the agricultural land and also threatened that they would set fire on the straw bales. When the son of the petitioner came to rescue the petitioner, they threatened his son also. In the above said incident, he sustained injury, due to which, he admitted in the Government District Head Quarters Hospital, Kumbakonam, as inpatient. Thereafter, the police came to the said Hospital and obtained statement from the Page No. 2 of 5

petitioner. However, they have not registered FIR. Therefore, he filed this petition.

The learned Additional Public Prosecutor appearing for the respondents would submit that based on the intimation from the Government District Head Quarters Hospital, Kumbakonam, they went to the hospital and recorded the statement of the petitioner. Thereafter, the son of the petitioner stated that they have entered into the compromise between them. Thereby, they have not registered the case. However, the petitioner, now, filed this petition. Hence, they will consider the representation of the petitioner, dated 16.09.2024 and will dispose of the same within one week from the date of this order.

5. This Court heard both sides and perused the records.

6. Considering the limited scope of the prayer sought for in this petition, this Court is inclined to dispose of this petition at the stage of admission itself.

7. Recording the submission of the learned Additional Public Page No. 3 of 5

Prosecutor, this Court directs the third respondent police to take appropriate action on the petitioner's representation, dated 16.09.2024 and dispose of the same within a period of one week from the date of this order.

8. With the above said direction, this Writ Petition is disposed of. No costs.
