FOR BAIL IN CRIME NO.25 OF 2024 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 23.01.2024 for the offence punishable under Sections 294(b), 328, 353, 506(2) IPC and Section 24(1) COTPA Act in Crime No.25 of 2024, on the file of the respondent Police, seeks bail.

2.The case of the prosecution is that the petitioner was found in illegal possession of 9 pockets of banned Ganesh 701 Tobacco (weighing 15 grams each pocket) . Hence, the case.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he did not commit any offence as alleged by the prosecution.

4.The learned Additional Public Prosecutor appearing for the respondent Police would submit that the petitioner is having 11 previous cases, in which 4 cases were registered for the offence punishable under Section 302 IPC. Therefore, he vehemently opposed to grant bail to the petitioner. 5.Considering the facts and circumstances of the case and also considering the bad previous antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
