COMMON ORDER The petitioners, who are the accused, apprehending arrest at the hands of the respondent police for the offences punishable under section 379 I.P.C. and Section 21(1) of Mines and Minerals (Development and Regulation) Act, on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that while the Deputy Tahsildar was returning from Periyakulam towards his office, it was found that a Tractor bearing registration No.TN 23 AR 4696 and Trailer No.TN 60 K 6102 was carrying one unit of gravel sand, which was driven by the petitioners and other accused without prior permission. When the Deputy Tahsildar asked the petitioners about the same, they were unable to give explanation. Hence, the present complaints.

3.Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Crl. Side) appearing for the respondent.

4.The learned counsel appearing for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. He further submitted that the petitioners are not having any bad antecedent. Hence, he prayed for grant of anticipatory bail to the petitioners.

5. The learned Government Advocate (Crl. Side) appearing for the respondent Police has produced a communication letter addressed to the Assistant Divisional Engineer, Highways Construction and Maintenance, Theni District, with regard to the work of laying of paver block as per CRIDP 2020-2021 Scheme and admitted that the said work is going on in that place.

6.It is seen that the Assistant Divisional Engineer, Highways Construction and Maintenance, Theni District, has permitted ten vehicles for removal of gravels sand laying paver block and for constructing drainage in the National Highways, 45 extension, Theni Nagar area, from 3/4 km to 6/6 km in, in which, the petitioners' vehicles are listed as 4, 7 and 8.

7.Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.

8.Accordingly, these petitions are allowed and the petitioners are ordered to be released on bail in the event of arrest or their appearance, within a period of two weeks from the date of receipt of a copy of this order, before the learned Judicial Magistrate, Theni, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the respondent Police or to the Police Officer, who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that: (a)the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

(c)the petitioners shall report before the respondent police as and when required for interrogation;

(d)the petitioners shall not tamper with evidence or witness either during investigation or trial;

(e)the petitioners shall not abscond either during investigation or trial;

(f)on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;

(g)if the accused/petitioners thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
