Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the 3rd respondent to submit a proposal to the 4th respondent to making necessary entries in the encumbrance certificate in respect of Survey Nos.56/3B, 189/A1, 189/A2, 194/3, 189/A1, 196/3, 196/4, 194/2A, 194/2B, 194/1, 195, 196/2 to an extent 5 Acres and 49 Cents situated at

Veeralapatti Post, Chinnakarattupatti Village, Ottanchatram Taluk, Dindigul District and in the light of order made in W.P.(MD).No.1003 of 2024, dated 29.04.2024 on the file of this Court by considering the petitioner's representation, dated 26.12.2024 within the period that may be stipulated by this Court.

ORDER

The petitioner seeks for a writ of mandamus to direct the 3rd respondent to submit a proposal to the 4th respondent to make necessary entries in the Encumbrance Certificate in Survey Nos.56/3B, 189/A1, 189/A2, 194/3, 189/A1, 196/3, 196/4, 194/2A, 194/2B, 194/1, 195, 196/2 of the property situated at Veeralapatti Post, Chinnakarattupatti Village, Ottanchatram Taluk, Dindigul District.

2. The petitioner states that his father, Subba Naickar, had executed a settlement deed in favour of his son Sangeswaran. Subsequently, he approached the Revenue Divisional Officer, Palani, Dindigul District under the provisions

of Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The 3rd respondent, by his order, dated 14.12.2023, cancelled the settlement deed invoking Section 23 (1) of the said Act. Aggrieved by the same, the petitioner preferred W.P(MD)No.1003 of 2024. After hearing both sides, the writ petition came to be allowed on 29.04.2024. The petitioner states that no appeal has been preferred against the said order so far. He gave a representation to the respondents on 26.12.2024 seeking for a direction to make the necessary entries in the Encumbrance Certificate. Since the same was not considered, the present writ petition.

3. When the matter came up for admission, Mr.P.T.Thiraviam, learned Government Advocate took notice and informed that appropriate entry will be made in the register of the 4th respondent.

4. Today when the matter was called, Mr.P.T.Thiraviam, learned Government Advocate has produced the Encumbrance Certificate to show that the order of this Court in W.P(MD)No.1003 of 2024, dated 29.04.2024 has been entered in the Encumbrance Certificate. As the relief sought for in the writ petition has been addressed, no further orders are required in this writ petition.
