ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 468 and 420 IPC in Crime No.142 of 2014 and hence, seeks anticipatory bail.

2. The defacto complainant is the husband of the first petitioner. The allegation against the petitioners is that when the divorce petition filed by the defacto complainant and the restitution application filed by the first accused were pending, they sent an affidavit to the Indian Army stating that there was no case pending against the defacto complainant and the first accused. The accused Nos.2 and 3, who are already working in the Indian Army joined with the first accused, have given false information to the Indian Army.

3. The learned counsel for the petitioners submits that the petitioners are innocent and they have not committed any offence.

4. Heard the learned Government Advocate (Crl.Side).

5. Considering the allegation against the petitioners, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Andipatti, Theni District and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
