ORDER

Seeking to direct the 1st to 3rd respondent police not to interfere in the civil dispute between the petitioner and the 4th respondent till the disposal of the suit pending on the file of the Principal District Judge, Dindigul, in O.S.No.330 of 2022.

The learned counsel for the petitioner submitted that the petitioner had lodged a complaint as against the 4th respondent with respect to forgery of her father's signature and other documents for the purpose of reconstituting a partnership firm. The 3rd respondent police had already registered a case in Crime No.44 of 2021 as against the 4th respondent. Against which, the 4th respondent had filed a quash petition before this Court in Crl.OP(MD)No.998 of 2022 which was dismissed on 24.01.2024. After dismissal of the said petition, the 4th respondent, filed a suit in O.S.No.330 of 2022 for rendition of accounts before the learned Principal District Judge, Dindigul and the same is pending. Pending the said civil suit, the 4th respondent has lodged a complaint before the respondent.

It is also submitted that the petitioner has given a second complaint before the Inspector of Police, Town North Police Station, Dindigul, in which Crime No.26 of 2026 was also registered as against the 4th respondent on 15.01.2026. However, now at the instance of the 4th respondent, the 3rd respondent police is subjecting the petitioner to harassment.

4. The learned Government Advocate (Crl.Side) submitted that the 3rd respondent police never subjected the petitioner to any harassment. However, the 4th respondent has sent a representation to the 1st respondent police which was forwarded to the 2nd respondent. The 2nd respondent required the petitioner to appear for inquiry.

5. Heard the submissions made on either side and perused the materials available on record.

6. From the submissions made by the learned counsel for the petitioner, it is seen that already on the summons issued by the 2nd respondent, the petitioner had appeared before him on 05.02.2026 and 3/6

had given all necessary details as to her innocence and even after that, the 2nd respondent is requiring the petitioner to appear before him on 16.02.2026. In this regard, already civil suit is pending before the learned Principal District Judges, Dindigul District, and it is all a matter of partnership.

Considering the same, the 2nd respondent is directed not to interfere with the civil matter between the petitioner and the 4th respondent pending disposal of O.S.No.330 of 2022 on the file of the Principal District Judges, Dindigul District, and direct the 4th respondent to solve the disputes before the appropriate civil Court.
