Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 to A3 apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147 and 366 of IPC, in Crime No.457 of 2014 on the file of the respondent police and hence, seek anticipatory bail. 2.According to the prosecution, the petitioners had kidnapped the daughter of the defacto complainant on 13.12.2014. 3.The learned counsel appearing for the petitioners submitted that the defacto complainant has filed a H.C.P.No.15 of 2015 before this Court and the alleged detenu was produced before the Court on 17.03.2015 and she has given a statement that she had voluntarily left the matrimonial home and the accused had not kidnapped the victim. He further submitted that the petitioners are innocent persons and they have not committed any offence.

4.The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the alleged victim is secured. 5.Considering the facts and circumstances of the case and also considering the fact that the victim is secured, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned District Munsif-cum-Judicial Magistrate, Orathanadu and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with common surety for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear https://hcservices.ecourts.gov.in/hcservices/

before the respondent police as and when required. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
