COMMON ORDER : The Court Made the following order :- The petitioners are A5 and A4 and they were surrendered before the learned Judicial Magistrate No.2, Madurai on 12.01.2015 for the alleged offence punishable under section 302 of IPC, in Crime No.3 of 2015 on the file of the respondent police and hence, seeks bail respectively. 2.The case of the prosecution is that on 06.01.2015 at 7.30 p.m., when the deceased was proceeding on his motor cycle, A6 and A7 waylaid him and A6 attacked the deceased with Aruval and caused the death of the deceased. 3.The learned counsel appearing for the petitioners submitted that the petitioners have surrendered before the learned Judicial Magistrate No.2, Madurai on 12.01.2015 and they were remanded to judicial custody. It is further submitted that even as per the case of the prosecution, the petitioners are only conspirators and they have not directly involved in the commission of the offence and they have been in judicial custody for more than 85 days.
4.The learned Government Advocate (Criminal side) submitted that A1 to A3 and A7 are still at large and A6, who is the assailant has already been arrested and remanded to judicial custody and the investigation is at the initial stage.
5.However, considering the facts and circumstances of the case and also considering the fact that the petitioners have been in judicial https://hcservices.ecourts.gov.in/hcservices/
custody since 12.01.2015 and the overtact attributed against the petitioners, this court is inclined to enlarge the petitioners on bail with certain conditions.
6.Accordingly, the petitioners are ordered to be released on bail, on each of them executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Aranthangi and on further condition that the petitioners shall stay at Dindigul and report before the Inspector of Police, attached to Dindigul Taluk Police Station daily at 10.00 a.m. and 05.00 p.m. until further orders. sd/- 07/04/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
