PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of Certiorarified mandamus calling for the records relating to the impugned order passed by the third respondent vide proceedings in NO. 122/Vu.tha.2/2026 dated 05.02 2026 and quash the same as void and illegal and consequently grant 21 days ordinary leave without police escort to the petitioner G.Radhakrishnan, S/o.Ganapathy Subramaniyan, aged 63 years, CP No.9196, PID No.28820 now confined at Central Prison, Madurai- 625 016 forthwith considering the representation dated 20.01.2026 For Petitioner :

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the third respondent in No. 122/Vu.tha.2/2026 dated 05.02 2026 and consequently grant 21 days ordinary leave without police escort to the petitioner G.Radhakrishnan, S/o.Ganapathy Subramaniyan, aged 63 years, CP No.9196, PID No.28820 now confined at Central Prison, Madurai- 625 016 forthwith considering the representation dated 20.01.2026
2. It is the case of the petitioner that he was convicted by the learned II Additional District Judge for CBI Cases, Madurai in C.C.No.4 of
2008 2007 on 07.10.2026 and sentenced to undergo five years rigorous imprisonment for the offence under Section 120(B) r/w.420 of IPC. Aggrieved over the same, he has filed an appeal before this Court in Crl.A(MD) No.389 of 2016 and the same was dismissed. Therefore the petitioner submitted representation seeking 21 days ordinary leave , however it was rejected on the ground that the Probation officer has not supported the case of the petitioner
3. Accordingly, the order of the first respondent dated 05.02.2026 is set aside and the petitioner is granted 21 days ordinary leave without escort on condition the convict shall report before the fifth respondent daily at 5.30 pm., till the completion of leave period.
