PRAYER: Petition filed under Section 11 of the Contempt of Courts Act, to punish the Contemnors/respondents for their willful, deliberate, disobedience of the order of this Court made in W.P(MD)No.26720 of 2019 dated 01.07.2022.

ORDER

Heard the learned Senior Counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents. 2.The order passed by this Court on 01.07.2022 in W.P(MD)No. 26720 of 2019 has been complied with. The respondents originally took the stand that the patta can be issued only for 679 Sq.ft of land not for the entire land. According to the respondents, a portion of the land has been occupied by National Highways Authority of India (NHAI) to form road over-bridge.

3.The learned Senior Counsel appearing for the petitioner states that the pillars of the bridge have been laid on the petitioner's land. I direct the respondents to issue patta for the entire extent of land so as to enable the petitioner to approach NHAI for getting compensation for the land that has been taken over by them. Pursuant to the direction given by this Court, the jurisdictional Tahsildar has issued patta indicating the petitioner's entitlement for the entire extent of land. Based on the patta issued by the respondents, the petitioner can very well move NHAI for obtaining appropriate compensation for the occupied area. 4.This contempt petition is disposed of accordingly. There shall be no order as to costs.
