ORDER

This Criminal Original Petition has been filed to direct the second respondent to register an F.I.R. on the basis of the petitioner's complaint dated 22.01.2018 lodged before the second respondent in person which, had been acknowledged in C.S.R.No.13 of 2018 dated 22.01.2018.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3.The learned counsel for the petitioner submits that the proposed accused has borrowed money from the petitioner on various occasions for developing his business. When the petitioner demanded the proposed accused to repay the money, the proposed accused abused and ill-treated the petitioner. Hence, the petitioner lodged a complaint before the respondent police. Since no action has been https://hcservices.ecourts.gov.in/hcservices/

taken, the present Criminal Original Petition has been filed by the petitioner.

4.The learned Additional Public Prosecutor appearing for the respondents submits that after receipt of the complaint CSR No.13 of 2018 has been issued and the same is pending for enquiry. 5.In view of the above submission, considering the nature of offence in complaint lodged by the petitioner, this Court cannot entertain this Criminal Original Petition. However, liberty is granted to the petitioner to approach the appropriate forum for getting appropriate remedy.

6.Withe the aforesaid observation, the Criminal Original Petition is dismissed.
