Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the first respondent to take action against the second respondent herein and consequently, evict the second respondent from the Shop No.96 A situated in the Mattuthavani Integrated Bus Stand, Madurai.

ORDER

This writ petition has been filed for a direction to the first respondent to take action against the second respondent herein and consequently, evict the second respondent from the Shop No.96-A situated in the Mattuthavani Integrated Bus Stand, Madurai.

2. The case of the petitioner is that the second respondent is running the Shop No.96 A situated at Mattuthavani Integrated Bus Stand, Madurai, without any valid license and though the petitioner submitted a representation to evict the second respondent as he is running the shop without licence and the first respondent did not take any action. Hence, he has come up with this writ petition.

3. The learned counsel for the second respondent submitted that the second respondent by earlier Writ Petition in WP(MD). No.2180 of 2014 sought for a direction to the first respondent herein for issuance of licence and based on the order dated 25.02.2014 passed in the said Writ Petition, licence has been given to second respondent and he is running the shop by due licence. https://hcservices.ecourts.gov.in/hcservices/

4. In view of the fact that second respondent is running the shop with valid licence, this Writ Petition cannot be maintained. Accordingly, this Writ Petition is dismissed. No costs.
