ORDER : The Court Made the following order :- The petitioner is A7 and he was arrested and remanded to judicial custody on 12.01.2015 for the alleged offences punishable under sections 8(c) r/w 20(b)(II)(c) and section 25 of NDPS Act, in Crime No.68 of 2014 on the file of the respondent police and hence, seeks bail.
2.The case of the prosecution is that the accused were found in joint possession of 192 kgs of Ganja.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case, based on confession of the co-accused. He further submitted that the petitioner has been in judicial custody from 12.01.2015.
4.The learned Government Advocate (Criminal side) appearing for the respondent submitted that the investigation is almost over and A1 to A4 were already arrested and they have been in judicial https://hcservices.ecourts.gov.in/hcservices/ custody and the petitioner/A7 helped the other accused persons to smuggle the contraband to Srilanka, by using his Country Boat.
5.However, considering the facts and circumstances of the case and also considering allegation made against the petitioner and the petitioner is in jail since 12.01.2015, this Court is inclined to grant bail to the petitioner with certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail, on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Additional District and Sessions Judge/Presiding Officer, Special Court for E.C. and NDPS Cases, Pudukottai and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m. and 05.00 p.m. until further orders.
