O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to make appropriate arrangements for accepting the petitioner's online application for grant of separate patta in respect of the property comprised in Re-Sy.No.482 of Kaliyal Village, Vilavancode Taluk, Kanniyakumari District, owned by the petitioner, by considering the petitioner's application dated 01.09.2025, within a time to be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself. Page No. 2 of 6

The grievance of the petitioner is that the property in Re-Sy.No. 482, measuring an extent of 10 Acres and 13 Cents, originally belonged to the petitioner's mother, out of which 25 cents was donated by her to the State Bhoodan Board. The remaining extent of 9 Acres and 88 Cents was allotted to the petitioner in a partition among the siblings. Out of the said extent, the petitioner sold 3 acres to his brother. Consequently, the joint patta stood in the names of the petitioner, his mother, his brother and the State Bhoodan Board.

4. Thereafter, the petitioner attempted to submit an online application for issuance of separate patta. However, the application was rejected by the system stating that the property was "blocked". The petitioner therefore approached the fourth respondent. The fourth respondent conducted a spot inspection and concluded that the 25 cents donated to the Bhoodan Board was lying vacant with separate boundaries and that the remaining property, as per the title documents and 'A' Register, stood in the names of the petitioner and his brother.

5. Though the fourth respondent forwarded a report to the third respondent, no action has been taken by the respondents. The petitioner Page No. 3 of 6

subsequently came to know that on the ground of excess extent of 27 cents, the application was kept pending without any basis. Even thereafter, when the petitioner again attempted to submit the online application, the system refused to accept it on the same ground. Hence, the petitioner submitted representations dated 01.09.2025 and 23.01.2026 to the respondents. Since the same have not been considered, the petitioner has been constrained to file the present Writ Petition.

6. The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that the petitioner's representation dated 01.09.2025 would be considered and appropriate orders would be passed by the first respondent within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's representation dated 01.09.2025 and pass appropriate orders on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be disposed of Page No. 4 of 6

after conducting an enquiry. The first respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order. There shall be no order as to costs.
