O R D E R
This Criminal Original Petition is filed for a direction to the second respondent not to harass the petitioner under the guise of enquiry.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal Side) appearing for respondents 1 and 2.
3. The petitioner admits that she is the wife of the third respondent and she makes so many allegations against the third respondent. It is stated that the third respondent has also given a complaint to the second respondent about the ill-treatment, the petitioner had suffered and also for getting the custody of child. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Government Advocate(Criminal Side) however on instructions submitted that the third respondent also has given a
complaint stating that the petitioner is missing. It is presumed that the petitioner has gone with someone and her whereabouts are not known to the second respondent police. He further submitted that it is only to cover up her conduct, it appears that the petitioner has approached this Court with the prayer not to harass her, even though there is no cause and there is no bonafides.
5. Be that as it may, since the complaint has already been given by the third respondent and the second respondent has to deal with the complaint. The petitioner is directed to appear before the second respondent and to explain her stand. The petitioner shall also inform her address to the second respondent so that the second respondent will be in a position to send summons. If the petitioner co-operates, there will not be any harassment.
6. The learned Government Advocate(Criminal Side) ensures that there will not be any harassment and that the petitioner's appearance will give a quietus to the enquiry and to close the complaint.
7. With the above observation, the Criminal Original petition is closed.
