PRAYER :- C-38B. For Bail in Crime no.3 of 2026 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 22.01.2026 for the offences punishable under Sections 296(b), 64, 318(2) and 351(2) of BNS, 2023, in Crime No.3 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 03.06.2025, the petitioner and his parents visited the victim girl's house with a marriage proposal and the proposal was not succeeded. Thereafter, she voluntarily called upon him over phone and they were talking with each other very often. During such period, the petitioner on false promise of marriage, had sexual intercourse 2/6

with the victim girl due to which, she became pregnant. Hence, the complaint.

3.After considering the facts and circumstances, this Court has already granted interim bail to the petitioner with certain conditions and listed the matter today with regard to the DNA Test.

4. When the matter is taken up for hearing today, the learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that they are awaiting the result of the DNA test.

5. Recording the submission made by the learned Government Advocate (Crl. Side) for the respondent, nature of offence, and considering the fact that they are awaiting the result of the DNA test and no previous case is pending against 3/6

the petitioner and also considering the period of incarceration undergone by the petitioner from 22.01.2026, this Court is inclined to confirm the interim bail already granted by this Court.

6.Accordingly, the interim bail already granted is made absolute and the petitioner shall report before the respondent once in a month ie., on the first working day of Every English Calender month at 10.30 a.m., for a period of three months and thereafter, as and when required for interrogation and all other conditions imposed on the petitioner shall remain intact.
