ORDER

This Criminal Original Petition has been filed to direct the learned Sessions Judge, Special Court for exclusive trial of SC/ST (POA) Act Cases, Pudukkottai, to accept the surrender of the petitioner and consider his bail application on the very same day on merits in connection with Crime No.10 of 2026 on the file of the second respondent.

2.Since there is no adverse order passed against the 3rd respondent, notice to the 3rd respondent is dispensed with. 3.The case of the prosecution is that due to property dispute, on 19.12.2025, at about 05:00 p.m., when the defacto complainant went to 2/5

see his land, the petitioner and one Chidambaram were sitting near the land. At that time, the defacto complainant requested the said Chidambaram to inform the petitioner to hand over the land after harvest. Thereafter, the petitioner abused the defacto complainant in filthy language mentioning his community name and removed boundary stones. Based on these allegations, an FIR has been registered against the petitioner.

4.Heard the learned counsel on either side and carefully perused the materials available on record.

5.Considering the limited scope of the relief sought for, this Court hereby directs the learned Sessions Judge, Special Court for exclusive trial of SC/ST (POA) Act Cases, Pudukkottai, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.10 of 2026 on the file of the 2nd respondent police.
