JUDGMENT

The appellant is the sole accused in Spl.S.C.No.3 of 2018 on the file of the Mahila Court, Pudukkottai. He was charged for the offence under Sections 3(b) r/w. Section 5(m) r/w. 6 of Protection of Children from Sexual Offences Act, 2012 altered into Section 5(m) r/w. 6 of POCSO Act. The trial Court, by its Judgment dated 27.02.2020, convicted the appellant for the offence under Section 5(m) r/w. Section 6 of POCSO Act, 2012 and sentenced him to undergo 10 years rigorous imprisonment and to pay a fine of Rs.1,000/- in default to undergo one month simple imprisonment. Challenging the Judgment of conviction and sentence, the appellant/accused has filed this appeal along with the petition for suspension of sentence.

2. Today, when the matter is taken up for hearing, there is no representation for the appellant.

3. The learned Government Advocate (Crl. Side) has produced a letter of the Inspector of Police, All Women Police Station, Aranthangi, Pudukkottai District and submits that while the appellant/accused was in 2/4

Central Prison, Tiruchirappalli, he was admitted for certain ailments in Mahatma Gandhi Memorial Government Hospital, Trichy and he died in the hospital on 08.03.2024 and hence, the charge is abated.

4. Since it is reported that the appellant/accused died and the charge is abated, this Criminal Appeal is closed. Consequently, Crl.M.P.(MD)No. 7728 of 2022 filed for suspension of sentence is also closed. 10.02.2025 ogy NCC : Yes / No.
