RESPONDENT/ COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to suspend the Sentence of Imprisonment imposed by the learned Sessions Judge (FAC), Mahila Court, Pudukkottai in Spl.S.C.No.3 of 2018 dated 27.02.2020 and enlarge the petitioner/Appellant on bail, pending disposal of the above said Criminal Appeal Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.D.RAMESHKUMAR, Advocate for the petitioner and of Mr.K.DINESH BABU, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- The petitioner has filed this petition to suspend the sentence of imprisonment imposed in Spl.S.C.No.3 of 2018 dated 27.02.2020 on the file of the learned Sessions Judge (FAC), Mahila Court, Pudukkottai and to enlarge the petitioner on bail, pending disposal of the above said criminal appeal.
2.On the side of the petitioner, it is stated that the petitioner is aged about 73 years and he is undergoing treatment and prays the petitioner to be released on bail.
3.On the side of the prosecution, it is stated that the offence is serious in nature and the victim is only 3 1⁄2 girl child. The victim was abused by the petitioner and there is clear evidence to that effect in the deposition of the victim and in the deposition of the doctor and prayed the petition to be dismissed. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.2296 of 2020 4.A perusal of the records reveals that the offence against the petitioner is a serious one. The petitioner is getting treatment in the prison itself.
5.In the above circumstances, the reasons stated in the affidavit filed in support of this petition are not satisfactory and this petition is dismissed.
