Transfer Civil Miscellaneous Petition filed under Section 24 of Civil Procedure Code to withdraw the H.M.O.P. No. 2 of 2024 before the Learned 2nd Additional Subordinate, Coimbatore and transfer the same to the file of Learned Subordinate Judge, Tiruchendur.

ORDER

Today the matter has been listed under the caption 'for being mentioned'.

2.It was pointed out by both the learned Counsel for petitioner and respondent that it was mutually agreed to transfer the H.M.O.P. No. 2 of 2024 before the II Additional Subordinate, Coimbatore to Principal Sub Court, Madurai. Endorsement was also made as early as on 07.06.2024. This was not brought to the notice of this Court when the matter was disposed of on 04.12.2025. In view of the mutual consent, they request that the matter be transferred to Principal Sub Court, Madurai.

3.In view thereof, the paragraph Nos.4, 5, 6 and 7 of the order dated 04.12.2025 is replaced with the following paragraphs: "4.Mr.A.Mohamed Haneef, learned Counsel for Petitioner and Mr.Yogeswaran, learned counsel for Respondent on instructions submitted that the parties have mutually agreed to transfer the HMOP.No.02 of 2024 from the file of II Additional Subordinate Court, Coimbatore to the file of Principal Sub Court, Madurai.

5.In view thereof, HMOP No.02 of 2024 pending on the file of II Additional Subordinate Court, Coimbatore, is hereby ordered to be withdrawn and transferred to the file of Principal Sub Court, Madurai. Principal Sub Court, Madurai, is directed to dispose of the aforementioned case expeditiously, preferably within a period of six months. 6.With the above observations, the Transfer Petition is disposed of. There is no order as to costs. Consequently, connected Miscellaneous Petition is closed. 16-12-2025 LR To
