ORDER : The Court Made the following order :- The petitioner/12th accused, was arrested and remanded to judicial custody on 01.01.2017 for the alleged offences punishable under Sections 395, 397, 212, 120(b) IPC and Section 3 of TNPPDL Act r/w under Section 34 of IPC in Crime No.367 of 2016 on the file of the respondent police and hence, seeks bail.
2.The learned Government Advocate (Crl.side) states that totally there are 30 accused and others and there are 7 named accused and the petitioner herein is arrayed as A12 as per the second alteration report filed in this case and on the basis of the confession statement given by the accused Rajendran Rs.3,10,000/- was recovered from A1 and Rs.2,00,000/- was recovered from A2. It is further admitted that the petitioner herein is implicated on the basis of the confession given by the co-accused and there was no sharing of amount with the petitioner by the other accused and the co-accused were granted bail by this Court and investigation is almost completed in this case.
3. The learned counsel for the petitioner states that the petitioner is innocent person and without proper investigation, the respondent police implicated the petitioner as accused and he was arrested on 01.01.2017 and he is in judicial custody.
4. Considering the above facts and circumstances of the case and also considering the fact that investigation is almost completed and no sharing of amount of Rs.30 lakhs with the petitioner by the https://hcservices.ecourts.gov.in/hcservices/
other accused as per the confession of the co-accused, this Court is inclined to grant bail to the petitioner with certain condition. Accordingly, the petitioner is ordered to be released on bail on each his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned District Munsif cum Judicial Magsitrate, Ilayangudi, and on further condition that the petitioner shall appear before the respondent police daily at 10.30., a.m., until further orders.
