PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying, to direct the I Additional Sessions Judge (PCR) Court, Thanjavur, to call for the records in S.T.C.No.267 of 2012 on the file of the Judicial Magistrate Court, Thiruthuraipoondi and club the case with S.S.C.No.27 of 2012 on the file of the I Additional Sessions Court (PCR), Thanjavur, pending on his file and consequently direct the I Additional Sessions Judge, (PCR) Court, Thanjavur, to conduct the trial of both cases simultaneously. For Petitioner : No Appearance For R1 : Mr.V.Neelakandan, Additional Public Prosecutor.

ORDER

This Criminal Original Petition has been filed, seeking for a direction, directing the I Additional Sessions Judge (PCR) Court, Thanjavur to call for the records in S.T.C.No.267 of 2012 on the file of the Judicial Magistrate Court, Thiruthuraipoondi and club the case with S.S.C.No.27 of 2012 on the file of the I Additional Sessions Court (PCR), Thanjavur, pending on his file and consequently direct the I Additional Sessions Judge, (PCR) Court, Thanjavur to conduct the trial of both cases simultaneously.

2.Today, when the matter is taken up for hearing, there is no representation on behalf of the petitioner. https://hcservices.ecourts.gov.in/hcservices/

3.The learned Additional Public Prosecutor appearing for the respondent police submitted that in both cases, trial has been commenced and witnesses have been examined. The case in S.T.C.No.267 of 2012 is posted on 04.10.2018 for further examination of witnesses.

4.In view of the above, the prayer sought for in this petition cannot be considered now. Accordingly, this Criminal Original Petition is dismissed.

Consequently, connected miscellaneous petition is closed.
