PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying, to permit the petitioner to file a petition seeking return of vehicle before the Judicial Magistrate, Valliyoor, instead of Judicial Magistrate Court, Kulithurai, for retrieve the Hero Honda Splender bearing Registration No.TN 75-C-9034, seized in Crime No.415 of 2013 on the file of the respondent police and direct the Judicial Magistrate, Valliyoor to entertain the petition filed by the petitioner.

ORDER

This Criminal Original Petition has been filed, seeking permission to file a petition to return of vehicle before the Judicial Magistrate, Valliyoor, instead of Judicial Magistrate Court, Kulithurai, for retrieve of the Hero Honda Splender bearing Registration No.TN 75-C-9034, seized in Crime No.415 of 2013 on the file of the respondent police and direct the Judicial Magistrate, Valliyoor to entertain the petition filed by the petitioner.

2.Today, when the matter is taken up for hearing, there is no representation on behalf of the petitioner. 3.The learned Additional Public Prosecutor appearing for the respondent submitted that the vehicle involved the Crime No.415 of 2013 has been deposited before the learned Judicial Magistrate, Kuzhithurai in R.P.No.279 of 2013. https://hcservices.ecourts.gov.in/hcservices/ 4.In view of the above, the prayer sought for in this

petition cannot be considered now. Accordingly, this Criminal Original Petition is dismissed.
