Prayer in CRL OP(MD). 2792/ 2019 :
To direct the 3rd respondent herein to investigate and file a report in Crime No.555/2017 on the file of Inspector of Police, City Crime Branch, Trichy in an expeditious manner and within the time stipulated by this Honourable Court.
ORDER:- This Revision/Appeal Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Ms. R.Meenakshi Sundaram, Additional Puplic Prosecutor for the Petitioner and of Ms. 1/3
M. Bindran, Advocate for the respondent, this Court made the following order:
The above application has been filed seeking further period of six months to complete the investigation and to file a final report, as per the direction of this Court dated 16.09.2022 made in Crl.M.P.(MD)No.10681 of 2022 in Crl.O.P.(MD)No.2792 of 2019.
2. It is seen from the records that this Court in Crl.O.P.(MD) No.2792 of 2019, considering the status report filed by the CBCID, directed the Investigating Agency to complete the investigation within a period of six months from the date of receipt of a copy of that order, vide order dated 24.04.2019. Subsequently, at the instance of the investigating officer, time was extended again and again, lastly, vide order dated 16.09.2022, five months further time was granted for completing the investigation.
3. The Inspector of Police, CBCID, Perambalur, who filed an affidavit in support of the above petition, has narrated the steps taken by them and wherein, it has been stated that out of seven accused, the third accused only was secured and subsequently was released on bail and they have already taken steps to get the property from the Odisha Court and that the other accused were from the different States and hence, they are not in a position to secure them, despite getting extension orders.
4. Considering the above facts and circumstances and also the reasons assigned by the investigating officer and also taking note of the issue pertaining to the inter-state, five months time is granted to the petitioners to complete the investigation finally. Accordingly, this Criminal Miscellaneous Petition stands disposed of.
