ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.08.2024 for the offences punishable under Sections 78, 127(8), 127(8) r/w. Sections 54, 308(5), 309(6), 76, 76 r/w. Section 70(1) of BNS 1/4

and Section 67 A of the Information Technology Act, 2000, in Crime No. 13 of 2024, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner, along with the other accused, sexually harassed the defacto complainant and also videographed the same. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner's father met with an accident and he has to take care of his father. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the accident in question took place in the year 2024 and the petitioner's father was provided with treatment thereafter, he had recovered, remaining hale and healthy. Further, the petitioner has now involved himself in a serious offence. Hence, he opposed for grant of bail to the petitioner.

5. The learned counsel appearing for the intervenor strongly opposed the grant of bail to the petitioner.

6. It is seen that the petitioner's father met with an accident in the year 2024 and he is hale and healthy. Further, the petitioner has now involved himself in a serious offence. Considering the above facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner.

7. Hence, this Petition is dismissed.
