O R D E R
This Writ Petition has been filed for a Mandamus seeking for a direction to the fourth respondent to consider the petitioner's representation, dated 12.02.2022 seeking for issuance of patta in his name for the property bearing Plot No.3 situated in 1/3
R.S.No.33/2 which is now subdivided into Re-Survey No.33/2A1A, Meenakshi Nagar, Thiruparankundram Village, Thiruparankundram Taluk, Madurai District to an extent of 3496 sq.ft., within a time frame to be fixed by this Court.
2.According to the petitioner, he is the absolute owner of the aforementioned property having purchased the same under a sale deed, dated 02.11.2021 registered as Doc.No.4302/2021. He claims that he is in possession of the aforementioned property. He has applied for patta with the fourth respondent on 12.02.2022 for the aforesaid property. Since the said application has not been considered till date, he has filed this Writ Petition. 3.Heard Mr.P.Jaganathan, learned Counsel for the petitioner and Mr.D.Sasikumar, learned Additional Government Pleader, who takes notice on behalf of the respondents.
4.No prejudice will be caused to the respondents, if the petitioner's application seeking for issuance of patta for the aforementioned property is considered on merits and in accordance with law after affording a fair hearing to the petitioner and other rival claimants, if any, within a time frame to be fixed by this Court.
5.Accordingly, this Court directs the fourth respondent to consider the petitioner's application, dated 12.02.2022 seeking for issuance of patta in his favour for the property bearing Plot No.3 situated in R.S.No.33/2 which is now subdivided into ReSurvey No.33/2A1A, Meenakshi Nagar, Thiruparankundram Village, Thiruparankundram Taluk, Madurai District to an extent of 3496 sq.ft ., and pass final orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order, after affording a fair hearing to the petitioner and other rival claimants, if any. 6.With the aforesaid directions, this Writ Petition is disposed of. No costs.
