Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/A1 apprehends arrest at the hands of the respondent police for the alleged offence punishable under section 420 of IPC, in Crime No.189 of 2014 on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that the accused persons were running a real estate business in the name and style of G.K.Win Groups Relators Private Limited and they have collected money from the subscribers, but failed to give loan to them. 3.Mr.V.Kathirvel, the learned Senior Counsel appearing for the petitioner submitted that A3 and A4 were the Directors of the Company and A2 was working as 'Office Assistant' in the Company and the petitioner is no way connected with the said Company. 4.The learned Senior Counsel has also produced the Company Registration Certificate, dated 15.11.2011, which shows that A3 and A4 are the Directors of the Company.

5.The learned Senior counsel further submitted that A2 was already granted anticipatory bail by this court, on the basis of the Indemnity Bond executed by A3 and A4 stating that they are only responsible for all the transactions of the Company.

6.It is further contented by the learned Senior Counsel that the respondent has completed the investigation and also laid a charge sheet in this case.

7.The learned Government Advocate (Criminal side) appearing for the respondent submitted that the investigation is over and the charge sheet also laid in this case.

8.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

9.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Aruppukottai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the trial court for all future hearings without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. 10.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
