ORDER : The Court Made the following order :- The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 07.01.2015 for the alleged offences punishable under Sections 4 & 8 of the Protection of Children from Sexual Offences Act, 2012, in Crime No.1 of 2015 on the file of the respondent police and hence, seeks bail. 2.The case of the prosecution is that the petitioner said to have attempted to sexual abuse to the daughter of the defacto complainant. 3.The learned counsel for the petitioner submitted that the petitioner and the de-facto complainant are neighbours and the daughter of the defacto complainant and the petitioner have fallen love with each other.
The petitioner has not committed any offence and the love affair was not liked by the defacto complainant and therefore, he has been falsely implicated in this case and prays for bail in favour of the petitioner. 4.The learned Government Advocate (Crl.side) has produced the case diary, which shows that the alleged victim has not sustained any external injury and there is no material that the petitioner had physical contact with the alleged victim/daughter of the defacto complainant. He further submitted that the respondent police has completed the investigation and also laid the charge-sheet in this case, which was taken on file in Spl.S.C.No.4 of 2015 on the file of the Additional Mahila Court, Pudukottai.
5.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two https://hcservices.ecourts.gov.in/hcservices/
sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Aranthangi and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders.
