NO. 5 OF 2016 ...RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to modify the condition to appear before the Court daily 10.30 a.m. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.M.VIVEKANANDAN, Advocate for the petitioner and of Mr.K.V.RAJARAJAN, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- Heard both sides.

2. It is represented by the learned Government Advocate [Criminal Side] for the respondent that the condition of appearance imposed by this Court has not been complied with. It is further represented that Charge Sheet in C.C.No.5 of 2016 has already been filed before the learned TNPID Court, Madurai.

3. Learned counsel for the petitioner has submitted that the petitioner has already surrendered before the concerned Court and executed sureties and since the petitioner, who is a lady having two school going female children, is residing at Coimbatore, she could not be able to appear before the TNPID Court, Madurai and therefore, she has come up with the present petition for modification.

4. The condition imposed by this Court on 23.09.2016 is modified to the effect that the petitioner shall report before the District Land Grabbing Cell, Coimbatore daily at 9:00am for 15 days and thereafter, before the TNPID Court, Madurai on all hearing dates, subject to the condition that the petitioner pays a sum of Rs.5,000/- (Rupees Five Thousand only) as costs to M.S.Chellamuthu Trust and Research Foundation, 611, K.K.Nagar, Madurai-625 020 (Mobile No.9629911343 within a period of two weeks from the date on which a copy of the order is made ready.

5. The Trial Court is directed to take up the case in C.C.No.5 of 2016 on day to-day basis without adjourning the same beyond two weeks at any point of time and bring the issue to a logical end.

6. This petition is ordered accordingly.
