PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure to direct the learned District Munsif cum Judicial Magistrate, Keeranur to consider the application to be filed by the petitioner to recall the non-bailable warrant issued as against him in P.R.C.No.13 of 2007 pending on the file of the learned District Munsif cum Judicial Magistrate, Keeranur, on the same day on merits in accordance with law.

O R D E R

This Criminal Original Petition is filed seeking a direction to the learned District Munsif cum Judicial Magistrate, Keeranur, to consider the application to be filed by the petitioner to recall the non-bailable warrant issued as against him in P.R.C.No.13 of 2007 on the same day on merits in accordance with law.

2.The learned counsel for the petitioner submitted that the petitioner would co-operate with the conduct of the trial and the petitioner would attend the future hearings.

3. The learned Government Advocate (Crl.side) submitted that the petitioner is absconding for nearly 5 years.

4. Though this Court is not inclined to allow this petition, considering the fact that the trial will have to go on and considering the submission of the learned counsel for the petitioner, this petition shall stand allowed. The court below is directed to consider the application filed to recall Non Bailable Warrant on the very same day on appearance of the petitioner.
