ORDER

This Criminal Original Petition has been filed to expunge the remarks made by the learned Judicial Magistrate, Rajapalayam against the petitioner in para 25 (second part) of the judgment rendered in C.C.No.174 of 2009, dated 03.04.2014.

2.The learned counsel appearing for the petitioner would submit that on the direction of the learned Judicial Magistrate, Rajapalayam, the department had taken action against the petitioner, in which he was punished with postponement of increment for two years. As against which, the petitioner has preferred an appeal before the Appellate Authority and the said punishment was set aside. Therefore, the prayer sought for in this petition has now become infructuous.
