Respondent PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to receive the application of the petitioner along with payment for each works and to issue tender schedules to the petitioner in respect of work Nos.1 to 21 in Tender Notice dated 23.03.2018 on the file of the respondent and to receive the tenders of the petitioner and open it in accordance with law.

O R D E R

The grievance of the petitioner is that the respondent herein, had refused to issue the tender notice and tender documents to him, which prompted the petitioner to file the present Writ Petition.

2. Today, when the writ petition came up for admission, the learned Additional Government Pleader appearing for the respondent, submitted that the petitioner herein, had not approached them for seeking tender notice and tender documents and in case the petitioner approaches the respondent even today, they are willing to issue the tender notice and tender documents. He also submitted that they are also willing to receive the sealed tender from the petitioner on or before 3:00 p.m. of 11.09.2018. https://hcservices.ecourts.gov.in/hcservices/

3. In view of the submissions made by the learned Additional Government Pleader appearing for the respondent, the petitioner cannot have any grievance.

4. As such, there will be directions to the respondent to issue the tender notice and tender documents to the petitioner forthwith, atleast by 10.04.2018 and consequently, the respondent shall also receive the sealed tender from the petitioner before the prescribed time with all the essential requirements mentioned in the tender schedule.

5. The learned Additional Government Pleader is also directed to inform the respondent with regard to the order passed by this Court today and the observations made in the present Order shall be complied with by the respondent without insisting for the copy of the order.

6. Accordingly, the Writ Petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
