ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent Police for the offence punishable under Sections 147, 341, 323 and 506(i) I.P.C., in Crime No.312 of 2017, on the file of the respondent Police, seek anticipatory bail.
2. Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the State.
3. The learned counsel for the petitioners submitted that the injured has been discharged from the hospiral, the petitioners are noway connected with the alleged offence, they are innocents and they have been falsely implicated in this case
4. The learned Additional Public Prosecutor submitted that the petitioners attacked the de facto complainant with stick and threatened him with dire consequences and he strongly objected to grant anticipatory bail to the petitioners.
5. Taking into consideration the facts and circumstances of the case and the fact that the injured has been discharged from the hospital, this Court is of the view that this is a fit case to grant anticipatory bail to the petitioners. Accordingly, they are ordered https://hcservices.ecourts.gov.in/hcservices/
to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate No.II, Kuzhithurai, on condition that each of the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the respondent Police or to the Police Officer, who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that:
(i) the petitioners shall report before the respondent Police daily at 10.30 a.m., for a period of one week and thereafter, as and when required for interrogation.
(ii) the petitioners shall not tamper with evidence or witness either during investigation or trial.
(iii) the petitioners shall not abscond either during investigation or trial.
(iv) the petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C., scrupulously.
6. The petitioners shall appear before the concerned Magistrate within a period of fifteen days from the date on which the order copy made ready, failing which, the petition for anticipatory bail would stand dismissed automaticaly.
