2010 on the file of learned III Additional District and Sessions Judge, Tirunelveli and set aside the same, and thereby delete the portion of evidence recorded in cross examination of RW38 and allow the revision case as prayed for.

When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) would submit that the learned Sessions Judge, after full trial, has passed a judgment in S.C.No.9 of 2010 on 24.02.2025 convicting the accused including the petitioner and also produced the copy of the judgment and as such, nothing survives for further adjudication.

3. Recording the same, this Criminal Miscellaneous Petition is

dismissed as infructuous. Consequently, Crl.R.C.(MD)SR.No.24757 of 2023 stands rejected at the SR stage itself.
