Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 and A2, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 294(b), 323, 324 and 506(ii) of I.P.C. in Crime No.160 of 2015 on the file of the respondent police and hence, seek anticipatory bail.

2.The case of the prosecution is that in regard to celebration of temple festival, there was a wordy quarrel arose between the de-facto complainant and the petitioners. Inspite of the same on the date of occurrence when the de-facto complainant along with his relatives had participated in the temple festival, the petitioner and five others attacked the de-facto complainant with hands and stones. 3.It is submitted by the learned Government Advocate (Crl.side) that the injured had already been discharged from the hospital and further submits that this is a case of case in counter. 4.Considering the facts and circumstance of the case and also considering the fact that the injured person had already been discharged from the hospital and this is a case of case in counter, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.

5. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Andipatti, Theni District and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the first petitioner shall appear before the respondent police daily at 10.00 a.m. for period of two weeks and the second petitioner being a college student studying B.E Mechanical Engineering at Pollatchi and therefore, the second petitioner shall appear before the respondent police as and when required https://hcservices.ecourts.gov.in/hcservices/

for interrogation. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
